Fondazione Consulcesi with registered office in Via Giacomo Peroni, 400, 00131 Rome (RM) (hereinafter the ” Data Controller”) constantly strives to protect the online privacy of its users. This document has been prepared pursuant to Article 13 of the EU Regulation 2016/679 (hereinafter: ” Regulation“) in order to allow you to learn about our privacy policy, to understand how your personal information is handled when you use our site (hereinafter also the “Site“) and, where applicable, to give your express and informed consent to the processing of your personal data. The information and data provided by you or otherwise acquired as part of the use of the Site’s services will be processed in accordance with the provisions of the Regulations and the obligations of confidentiality that inspire the activity of the Data Controller.

According to the rules of the Regulations, the processing carried out by the Data Controller will be based on the principles of lawfulness, fairness, transparency, purpose limitation and storage, data minimization, accuracy, integrity and confidentiality.

1. Data Controller

2. Personal data processed

Following the navigation of the Site, we inform you that the Data Controller will process your personal data which may be formed by an identifier such as a name, an identification number, an online ID or one or more factors specific to your physical, economic and cultural identity or social, in order to make the subject identified or identifiable (hereinafter also “personal data”).

The personal data processed through the Website are as follows:

a. Navigation data

The computer systems and software procedures of the Website may acquire some personal data whose transmission is implicit in the use of Internet communication protocols. This collected information cannot be associated with identified subjects but by their very nature could, through processing and associations with data held by third parties, permit to identify users. This category of data includes: IP addresses, URI addresses (Uniform Resource Identifier) of requested resources, time of request, the method used to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the response from the server (successful, error, etc..) and other parameters regarding the operating system and computer environment. These information is used to obtain anonymous statistical information about the site use and to check its correct operation, to allow the proper supply of services, for reasons of safety and liability assessment in case of hypothetical computer crimes against the Site or third parties, and are normally deleted after the processing.

b. Special categories of data

Through the use of some sections of the Website, it may be possible that you provide data falling within special categories of personal data pursuant to art. 9 of the Regulation, namely “personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation”. We invite you to provide these data only where necessary. We remind you that in case of transmission of special categories of personal without a specific consent for the processing of these data, Fondazione Consulcesi could not be held accountable for any reason, nor will accept disputes of any kind, since in this case the processing will be allowed as it relates to data manifestly made public by the interested party, in accordance with art. 9.1 of the Regulation. In any case, we specify the importance of giving explicit consent to the processing of special categories of data if you decide to share such data.

c. Data provided voluntarily by the data subject

In the use of some of the Services of the Site there may occur a processing of personal data of third parties sent by you to the Owner. With respect to such hypotheses, you stand as autonomous data controller, assuming all the obligations and responsibilities of the law. In this sense, it confers on this point the widest indemnity with respect to any dispute, claim, request for compensation for damages from processing, etc. that may be received by the Controller from third parties whose personal data have been processed through your use of the functions of the Site in violation of the applicable data protection regulations. In any case, should you provide or otherwise process personal data of third parties in the use of the Site, you warrant as of now – assuming all related liability – that this particular hypothesis of processing is based on a suitable legal basis under Article 6 of the Regulations that legitimizes the processing of the information in question.

3. Purposes of data processing

The processing we intend to carry out, upon your specific consent where necessary, has the following purposes:

a. to enable the provision of the services you have requested;

b.to respond to requests for assistance or information;

c.to fulfill any legal, accounting and tax obligations;

d. direct sales, marketing and profiling. The data provided may be processed, subject to explicit and specific consent, for the purpose of direct sales and / or for sending promotional and marketing communications, including the sending of newsletters and market research, through automated tools (sms, mms, email, push notifications, fax) and not (paper mail, telephone with operator), as well as for the analysis of personal data, purchasing choices and behavioral preferences on the Site, in order to better structure personalized communications and business proposals, to perform general analysis and, in general, for profiling activities.

It is also possible the occurrence of processing of personal data, sent by you to the Controller, relating to third parties. With respect to such hypotheses, you stand as autonomous data controller, assuming all the obligations and responsibilities of the law. In this sense, you grant on this point the widest indemnity with respect to any dispute, claim, request for compensation for damages from processing, etc., that may be received by the Controller from third parties whose personal data have been processed through your spontaneous submission in violation of the applicable data protection regulations. In any case, should you provide or otherwise process personal data of third parties, you warrant as of now, assuming all related liability, that this particular hypothesis of processing is based on an appropriate legal basis that legitimizes the processing of the information in question.

4. Legal basis for the processing and mandatory or optional nature of the processing

The legal basis for the processing of personal data for the purposes set out in Section 3 (a-b) is Article 6.1.b) of the Regulations as the processing is necessary for the provision of the Services or for the acknowledgment of requests from the data subject. The provision of personal data for these purposes is optional but failure to do so would result in the inability to activate the Services provided by the Site and to acknowledge requests for assistance and/or information.

The purpose referred to in Section 3.c represents legitimate processing of personal data under Article 6.1.c) of the Regulations. Once personal data is provided, the processing is indeed necessary to fulfill a legal obligation to which the Data Controller is subject.

The data provided for the purposes referred to in section 3. d may be processed, subject to your explicit and specific consent, to carry out direct sales and/or to send you promotional and marketing communications, including the sending of newsletters and market research, through automated (sms, mms, email, push notifications, fax) and non-automated (paper mail, telephone with operator) tools, as well as for the analysis of your personal data, purchasing choices and behavioral preferences on the Site, in order to better structure personalized commercial communications and proposals, to carry out general analysis and, in general, for profiling activities. The legal basis for the processing of your data for these purposes is Article 6, paragraph 1, letter a) of the Regulations. The treatments of commercial profiling and direct marketing are optional and depend on the free choice of the user; therefore, failure to provide consents for these purposes will not affect the use of services. For processing carried out for the purpose of sending its own advertising material or direct sales or for carrying out its own market research or commercial communications in relation to products or services of the Data Controller similar to those to be purchased, the Data Controller may use, without the consent of the data subject, the e-mail and paper mail addresses pursuant to and within the limits allowed by Article 130, paragraph 4 of the Code and the provision of the Authority for the Protection of Personal Data of June 19, 2008. The legal basis for the processing of your data for this purpose is Article 6, paragraph 1, letter f) of the Regulations. The data subject has the possibility to object to such processing at any time, either initially or on the occasion of subsequent communications, easily and free of charge also by writing to the e-mail address: contatti@fondazioneconsulcesi.org, as well as to obtain immediate feedback confirming the discontinuation of such processing (art. 15 of the Regulations).

Where necessary, specific summary information on the processing of personal data and requests for consent will be progressively reported or displayed on pages of the Site set up for particular services.

5. Recipients of personal data

Your personal data may be shared, for the purposes set out in section 3 above, with:

a.entities that typically act as data controllers under Art. 28 of the Regulations namely: (i) persons, companies or professional firms that provide assistance and consultancy to the Data Controller in accounting, administrative, legal, tax, financial and debt collection matters in relation to the provision of the Services; (ii) subjects with whom it is necessary to interact for the provision of the Services (e.g. hosting providers) (iii) or subjects delegated to carry out technical maintenance activities (including the maintenance of network equipment and electronic communication networks); (collectively “recipients”); the list of data processors that process data may be requested from the Data Controller by writing to the following addresses: contatti@fondazioneconsulcesi.org.

b.subjects, entities or authorities, autonomous data controllers, to whom it is obligatory to communicate your personal data by virtue of provisions of the law or orders of the authorities;

c.persons authorized by the Data Controller to process Personal Data under Article 29 of the Regulations necessary to perform activities closely related to the provision of the Services, who have committed to confidentiality or have an appropriate legal obligation of confidentiality (e.g., employees of the Data Controller);

d. subject to your specific consent, third parties with whom the Controller has entered into commercial agreements and/or conventions, belonging to the following categories: professionals and communication and marketing companies; professionals and companies operating in the legal, tax/fiscal, financial, accounting/administrative, insurance, training fields; professionals and companies in the health, medical/pharmaceutical and leisure service providers, for their marketing and promotional communication purposes.

6. Transfer of personal data

Regarding the possible transfer of Data to Third Countries, the Data Controller informs that the processing will take place according to one of the modalities allowed by the law in force, such as the consent of the data subject, the adoption of Standard Clauses approved by the European Commission, the selection of subjects adhering to international programs for the free circulation of data or operating in countries considered safe by the European Commission. 7. Storage of personal data

Personal data processed for the purposes referred to in section 3 (a-b) will be kept for the time strictly necessary to achieve those same purposes in compliance with the principles of minimization and limitation of storage ex art. 5.1.e) of the Regulations. In any case, the Data Controller will process personal data for as long as necessary to fulfill contractual and legal obligations.

8. Rights of the data subject

Pursuant to Articles 15 et seq. of the Regulation, you have the right to request at any time, access to your Personal Data, rectification or erasure of the same, restriction of processing in the cases provided for by Article 18 of the Regulation, obtain in a structured, commonly used and machine-readable format the data concerning you, in the cases provided for by Article 20 of the Regulation. At any time, you may revoke ex art. 7 of the Regulation the consent given; lodge a complaint with the competent supervisory authority ex art. 77 of the GDPR (Garante per la Protezione dei Dati Personali) pursuant to art. 77 of the Regulation, if you believe that the processing of your data is contrary to the legislation in force.

You can make a request to object to the processing of your data under Article 21 of the GDPR in which you give evidence of the reasons justifying the opposition: the Data Controller reserves the right to evaluate the request, which would not be accepted if there are compelling legitimate reasons to proceed with the processing that override your interests, rights and freedoms.
